This website is operated by TMC Computer Ltd T/A Playtech (NZBN: 9429039068569), a New Zealand registered company. Throughout this document, the terms "we", "us" and "our" refer to TMC Computer Ltd T/A Playtech. Our registered office is located at Playtech, 15d Paul Matthews Road, Rosedale, Auckland 0632, New Zealand.
By visiting our website (playtech.co.nz) and/or purchasing products or services from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"). These Terms apply to all users of the site, including browsers, customers, and vendors.
Please read these Terms carefully before accessing or using our website. If you do not agree to all terms and conditions, you must not access or use the website or purchase any products or services from us.
Note: These Terms do not limit your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand legislation. Those rights apply in addition to these Terms.
Section 1 — Online Store Terms
By agreeing to these Terms, you confirm that you are of the age of majority in your jurisdiction (18 years or older in New Zealand), or that you have obtained consent from a parent or guardian to use this site.
You may not use our products or services for any illegal or unauthorised purpose, and you must not violate any laws in your jurisdiction, including copyright laws. You must not transmit any malware, viruses, or code of a destructive nature. A breach of any of these Terms will result in immediate termination of your access to our services.
Section 2 — General Conditions
All prices displayed on our website are in New Zealand Dollars (NZD) and include GST (15%) unless otherwise stated. We reserve the right to refuse service to anyone for any reason at any time.
All specials, promotions, and advertised prices are while stocks last and subject to change without notice. We are not responsible for typographical or pricing errors on the website and reserve the right to cancel orders placed based on an incorrect price.
We use industry-standard security practices to protect your data. Our website operates over HTTPS, which encrypts data transmitted between your browser and our servers. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
You agree that we may send you service-related communications including order confirmations, shipping updates, and support correspondence. For marketing communications, we will seek your explicit consent.
Section 3 — Products & Desktop PC Builds
3.1 General Products
We reserve the right to limit the sale of our products or services to any person, geographic region, or jurisdiction. Product descriptions are provided in good faith and are as accurate as possible. Colours and specifications may vary slightly from images shown.
3.2 Desktop PC Builds
Unless otherwise stated, desktop PC systems are built to order. We also carry a range of in-stock systems that are ready for immediate collection or dispatch, generally within 2–3 hours during office hours — these will be clearly marked as “in-stock” on our website. Please note that customising an in-stock system may add a delay to when it ships or is available for collection. By placing an order for a desktop PC build, you agree to the following:
• Build times are estimates only, typically 3–7 business days from order confirmation, and may vary based on component availability and order volume. During peak periods (e.g. holidays), extended lead times will be communicated at the time of order.
• We reserve the right to substitute components of equivalent or superior specification where the originally specified component becomes unavailable, is end-of-life, or would cause unreasonable delays. We will notify you of any material substitution prior to completing the build.
• Once a desktop PC build has commenced (components ordered or assembly begun), cancellations may attract a restocking or labour fee of up to 15% of the order value. Cancellations prior to build commencement are accepted without penalty.
• Completed desktop PC builds that are functioning as specified are not eligible for change-of-mind returns unless a defect is identified under warranty.
Section 4 — Accuracy of Information
We make every effort to ensure that product information, pricing, and availability displayed on our website is accurate and up to date. However, we do not warrant that product descriptions, prices, or other content on the site is always accurate, complete, or current.
If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or refuse any orders placed at the incorrect price. We will notify you as soon as practicable if this occurs.
Section 5 — Warranty & Technical Support
5.1 Playtech Desktop PC Warranty
All Playtech desktop-built PC systems include a 3-year return-to-base warranty covering manufacturing defects and hardware failures under normal use. This warranty is in addition to, and does not limit, your rights under the Consumer Guarantees Act 1993.
The warranty covers:
• Hardware component failures under normal operating conditions
• Defects in workmanship and assembly
• Dead-on-arrival (DOA) components, subject to our DOA policy
The warranty does not cover:
• Physical damage caused by the customer, including drops, liquid damage, or improper handling
• Damage caused by power surges or use with incompatible equipment
• Modifications or repairs carried out by anyone other than an authorised Playtech technician without our prior written consent
• Software issues unrelated to hardware failure, including operating system reinstallation, driver conflicts, or user-installed software
• Normal wear and tear, including cosmetic deterioration
5.2 Lifetime Technical Support
Playtech desktop PC systems include Lifetime Technical Support. "Lifetime" means the operational lifetime of the PC system — defined as the period during which the system remains functional and repairable with commercially available parts. Lifetime Technical Support does not mean the lifetime of the purchaser.
Lifetime Technical Support covers general hardware troubleshooting and guidance. It does not include on-site visits, software licensing, virus/malware removal, or third-party application support, unless otherwise agreed in writing.
We will not charge labour fees to install upgrade components into your desktop PC system, provided those components are purchased from us.
Any modifications to the PC carried out by the end user or a third party without prior consultation with Playtech may void Lifetime Technical Support. If you are considering modifying your system, we recommend contacting us first.
5.3 Component & Peripheral Warranties
Individual components and peripherals (not part of a desktop PC build) carry the manufacturer’s warranty only. Warranty claims for these products must be directed to us in the first instance, and we will liaise with the manufacturer or distributor on your behalf where required under the Consumer Guarantees Act 1993.
Section 6 — Your Consumer Rights
Nothing in these Terms is intended to limit or exclude your rights as a consumer under New Zealand law. Under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, you have rights that cannot be excluded by contract. These include, but are not limited to:
• The right to receive goods that are of acceptable quality, fit for purpose, match their description, and are free from defects
• The right to a remedy (repair, replacement, or refund) where goods fail to comply with a consumer guarantee
• Protection against misleading or deceptive conduct
Where goods are purchased for business purposes, the Consumer Guarantees Act 1993 may not apply. If you are purchasing products for resale or business use, please advise us at the time of purchase.
We endeavour to provide accurate representations of the performance of our gaming desktop PC systems at the time of sale. However, we cannot be held responsible for changes in performance or compatibility that result from future updates made by software developers or game publishers. This is particularly relevant for early access titles or games that support third-party modifications (“mods”), where requirements and performance characteristics may change significantly over time and are outside our control.
Section 7 — Returns, Refunds & Exchanges
Our full Returns, Refunds & Warranty Policy is available here and is incorporated into these Terms by reference. Key points include:
• Change-of-mind returns must be initiated within 14 days of delivery via live chat at playtech.co.nz or by emailing hello@playtech.co.nz. Items must be in original, unused condition.
• Faulty or defective items are handled in accordance with the Consumer Guarantees Act 1993.
• All returns must be pre-authorised. Do not return goods without first obtaining a Service ID or reference number from our team.
• Certain products (as listed in our Refund Policy) are not eligible for change-of-mind returns due to legal restrictions or hygiene reasons.
Section 8 — Shipping & Delivery
If you have chosen a protected shipping option for your order, a signature is required upon delivery. If you circumvent this requirement by instructing the courier to leave the delivery unattended without obtaining a signature, you forfeit the ability to make a claim under your protected shipping option. Delivery timeframes are estimates only and are not guaranteed. We will not be liable for delays caused by the courier, customs, or circumstances outside our reasonable control. Risk of loss passes to you upon delivery.
If you receive a package that appears to be damaged on arrival, you may decline delivery and the courier will return the item to us for replacement.
We will not be held responsible for incorrect delivery addresses provided at the time of order. Please ensure all delivery details are correct before completing your purchase.
Section 9 — Third-Party Services & Links
Our website may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over, and accept no responsibility for, the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party site you visit.
We use third-party service providers to assist in operating our website and conducting our business (including payment processors, courier services, and email platforms). These providers are permitted to use your information only as necessary to perform services on our behalf and are required to maintain appropriate confidentiality.
Section 10 — Privacy & Personal Information
We collect and process personal information in accordance with the New Zealand Privacy Act 2020. Our full Privacy Policy is available here and is incorporated into these Terms by reference.
We collect personal information (such as your name, address, email, and phone number) for the purposes of processing orders, providing customer support, managing warranty claims, and where you have consented, sending marketing communications.

Section 11 — Intellectual Property
All content on this website, including text, images, logos, product descriptions, and software, is the intellectual property of TMC Computer Ltd T/A Playtech or its licensors and is protected under New Zealand and international copyright law.
You may not reproduce, distribute, modify, or republish any content from this website without our express written permission. Personal, non-commercial use for the purpose of viewing pages is permitted.
Section 12 — Limitation of Liability
To the maximum extent permitted by applicable law, we exclude all liability for any indirect, incidental, special, or consequential loss or damage arising from your use of our website or products. This includes but is not limited to loss of data, loss of profits, or business interruption.
Customers are responsible for maintaining their own backups of any data stored on products purchased from us. We cannot be held accountable for any data loss, whether arising from hardware failure, software issues, warranty service, repair, or any other cause. We strongly recommend maintaining regular backups of all important data.
Our total liability to you for any claim arising from or related to these Terms or our products shall not exceed the amount paid by you for the relevant product or service.
Important: The limitations in this section do not apply to any liability that cannot be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand legislation. Your statutory consumer rights remain unaffected.
Section 13 — Force Majeure
We will not be in breach of these Terms, and will not be liable for any delay or failure in performance, to the extent that such delay or failure arises from circumstances beyond our reasonable control. This includes but is not limited to:
• Global or domestic component supply shortages or semiconductor constraints
• Natural disasters, floods, earthquakes, or severe weather events
• Pandemics, epidemics, or government-imposed restrictions
• Strikes, industrial action, or courier disruptions
• Cyberattacks, telecommunications failures, or internet outages
In such events, we will notify you as soon as reasonably practicable and will work with you to find an appropriate resolution, which may include a modified timeline, component substitution, or order cancellation with full refund.

We will endeavour to resolve complaints promptly and fairly. If we are unable to resolve your complaint to your satisfaction, you may seek independent dispute resolution through:

• The Commerce Commission for complaints regarding Fair Trading Act matters — comcom.govt.nz
Section 15 — Governing Law & Jurisdiction
These Terms of Service and any disputes arising from them are governed exclusively by the laws of New Zealand. You and Playtech submit to the exclusive jurisdiction of the New Zealand courts.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
Section 16 — Changes to These Terms
We reserve the right to update, amend, or replace any part of these Terms at any time. Updated Terms will be posted to this page with a revised effective date. Your continued use of our website or services following any changes constitutes your acceptance of the updated Terms.
For material changes to these Terms, we will make reasonable efforts to notify you (for example, via a notice on our website or by email if you have an account with us).
